COVID-19 Waiver Signing

Participant/Parent’s Assumption of Risk and Waiver of Liability Relating to the Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization and the Governor of California has issued Emergency Orders concerning the pandemic. COVID-19 is extremely contagious and spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

While COVID-19 can cause mild symptoms in some individuals, it can lead to severe illness and even death in others. Adults over age 65 and people of any age with serious underlying medical conditions including, but not limited to, HIV, Diabetes, Cardiovascular Disease, Asthma, and other respiratory conditions, and woman who are pregnant, are at a higher risk for more serious complications from COVID-19.

The City of Temecula has put in place preventative measures to reduce the spread of COVID-19; however, the City cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, participation in sporting events at, but not limited to, City of Temecula athletic facilities could increase yours, and your child(ren)’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending and/or participating in sporting events at City of Temecula athletic facilities, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to ,or infected by COVID-19, after attending sporting events at City of Temecula may result from the actions, omissions, or negligence of myself and others, including, but not limited to, your organization’s employees, volunteers, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s participation in sports programs held on City of Temecula athletic surfaces. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the City of Temecula, Temecula Community Services District, their employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the City of Temecula, Temecula Community Services District, their employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any sports programs held on City of Temecula athletics surfaces.

WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19

ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT

In consideration of being allowed to participate in athletic programming, sanctioned activities and events (collectively “Sanctioned Activities”) related to the California State Soccer Association-South (Cal South) and affiliate members (“RELEASEES”), the undersigned acknowledges, appreciates, and agrees that:

1. Participation in such Sanctioned Activities inherently includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH INHERENT RISKS, both known and unknown, EVEN IF ARISING FROM THE ACTIVE OR PASSIVE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation in such Sanctioned Activities as regards to protection against infectious diseases. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Releasees their officers, directors, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the Sanctioned Activities , WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE ACTIVE OR PASSIVE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby agree to defend and indemnify RELEASEES for all such claims, causes of actions, allegations or matters arising out of, relating to, based upon or in any way connected to my participation in such Sanctioned Activities.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR CAL SOUTH PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I, for myself, my spouse, and child/ward, do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.

The signed waiver/release should be kept on file by the sports organization for at least 7 years and possibly longer if the player has contracted a serious illness.

Informed Consent, Assumption of Risk and Waiver of Liability for Communicable Diseases Including COVID-19

COVID-19 has been recognized by the World Health Organization as a global pandemic. COVID-19 is highly contagious and can be spread through person-to-person contact. I fully understand that there is a risk of exposure to disease, including, but not limited to, COVID-19.

Temecula Valley Soccer Association (TVSA) is implementing precautionary measures to reduce the spread of COVID-19. However, TVSA cannot guarantee that you and/or your child(ren) will not contract COVID-19 as a result of participation. Participating in the TVSA Soccer Season could increase your and/or your child(ren)'s risk of becoming infected.

By signing this Agreement, I acknowledge the contagious nature of COVID-19 and VOLUNTARILY ASSUME ALL SUCH RISK, including the risk that my child(ren) and I and anyone in my household may be exposed to or infected by COVID-19 and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I assume full responsibility for my child(ren)'s participation in the TVSA Soccer Season.

In consideration of my child(ren)'s participation in the TVSA Soccer Season I hereby agree to assume all risk and release, covenant not to sue, discharge and hold harmless TVSA from any and all liabilities, claims, actions, damages, or expenses of any kind for any injury to my child(ren) or myself (including but not limited to, personal injury, disability and death), illness, damage, loss, claim, liability or expense of any kind, that I or my child(ren) may experience or incur in connection with participation in the TVSA Soccer Season. I understand that this release includes any claims based on the actions, omissions, or negligence of TVSA, and TVSA representatives, including Board members, volunteers, program participants, their families, and anyone that I and/or my child(ren) may encounter, whether COVID-19 infection occurs before, during, or after participation in the TVSA Soccer Season.

By voluntarily signing this agreement I acknowledge that I have read, fully understood, and agreed to all terms within this Informed Consent, Assumption of Risk and Liability Waiver for Communicable Diseases Including COVID-19.
